Terms of service
Last updated 2026-10-16
These terms are the agreement between you and CLEVER SPARK SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (“Clever Spark”, “we”) for using Pathista. They are available free of charge before you sign up, and you can save or print this page at any time.
1. The service
Pathista lets you keep workflows — steps with instructions, and the ways from one step to the next — and have an AI assistant work through them one step at a time. It consists of:
- a web application to create and edit workflows, follow runs live, and manage your account;
- an MCP server (Model Context Protocol) that the assistants you connect use to start and drive runs, with sign-in by OAuth;
- a progress view that some assistants show in the chat.
Pathista has a free plan and a paid plan (Premium). What each plan includes and what Premium costs are on the pricing page; section 9 below says how paying works, and nothing will be charged without your separate agreement: you subscribe yourself.
2. What you need
- An internet connection and a current version of Chrome, Edge, Firefox or Safari with JavaScript and cookies enabled.
- An email address, to create an account.
- To use Pathista from an assistant: an MCP client that supports remote servers over HTTP with OAuth sign-in — for example ChatGPT (developer mode), Claude or Claude Code. Those services are provided by their own providers, under their own terms and, where applicable, their own fees.
3. Your account
You must be at least 16 years old and give an email address you control. Keep your password (and passkeys, recovery codes) to yourself; you are responsible for what is done with your account and with the assistants you connect to it. Tell us at once at support@pathista.com if you suspect misuse.
4. Your content and acceptable use
What you and your assistants store in Pathista — workflows, runs, notes — remains yours. You allow us to store, process and display it only as needed to provide the service to you.
You must not provide unlawful content or use Pathista unlawfully. In particular you must not:
- store content that is illegal, infringes others' rights, or that you have no right to store;
- attempt to access other accounts or data, probe or break the service's security, or bypass its limits;
- overload the service, or use it to distribute malware or spam;
- use Pathista to harm others.
5. Your AI assistant
The assistant you connect is a third-party service. Pathista guides it through your workflow — it hands the model one step at a time and refuses moves your workflow does not allow — but it does not control what the model writes or does. Model output can be wrong. Review what matters before you rely on it; decisions and actions taken with your assistant are yours.
6. How we handle content
Your content is private to your account. We do not monitor or review it proactively and use no automated tools to moderate it. We act on notices of illegal content (see how to report it) and on orders from authorities. If content is illegal or breaks these terms, we may remove or disable it, and for manifestly illegal content or repeated serious breaches we may suspend or close the account. We tell you what we did and why, and how to object; you can reply to us at support@pathista.com and we will review the decision. You can also go to court.
7. Availability
Pathista is under active development. We work to keep it running, but it is provided as it is, without a guaranteed level of availability, and may be interrupted for maintenance or changed. Runs are deleted automatically after the last activity of the run and of any run it started: 30 days on the free plan, 12 months with full access (see the privacy policy). Keep your own copy of anything important — you can export your data at any time (Account → Personal data).
8. Liability
We are not liable for the services of third parties, including the assistants you connect, nor for losses arising from relying on model output. Nothing in these terms limits liability that cannot be limited by law — for damage caused intentionally or by gross negligence, or under the mandatory rights of consumers.
9. Paid plans
Who sells Premium. Premium is sold by Paddle as the merchant of record: Paddle takes the payment on our behalf, works out and collects VAT or sales tax and sends you the invoice. Paddle's checkout buyer terms apply to the purchase. We run the service itself.
Price and renewal. The price is shown on the pricing page in US dollars, net of tax; tax, where it applies, is added at checkout and shown before you pay. A subscription renews by itself every month or every year, whichever you chose, at the price shown when you bought it, until you cancel. If we change the price, the new price applies from the next renewal after we have told you, and you can cancel before it.
Cancelling. You can cancel at any time in the app (Account → Subscription), as easily as you subscribed. Cancelling takes effect at the end of the period you have already paid for: you keep Premium until then and are not charged again.
When a plan ends. When Premium ends (you cancelled, a payment failed, or it was refunded in full) your account moves to the free plan. Your workflows are kept: one workflow stays active and the others are frozen, visible but not usable, and they come back as soon as you have Premium again. From then on the shorter free-plan period applies to runs, counted from each run's last activity, so runs idle for longer are deleted at the next daily clean-up. If a renewal payment fails, you keep Premium for 7 days while the payment is retried; after that the account moves to the free plan.
Refunds and your right to withdraw. The refund policy says when you get your money back and how, including the right of a consumer in the European Union to withdraw within 14 days. Premium is a digital service that starts as soon as you pay: before the payment window opens you tick a box in which you ask us to start it at once and acknowledge that you lose the right to withdraw once it has been fully provided. A full refund or a payment reversed by your bank ends Premium at once.
Closing your account while you pay. To close your account you first cancel the subscription, so that you are not charged again for an account that no longer exists.
10. Start and end of the agreement
The agreement starts when you create your account and confirm your email address, and lasts until it is ended. You can end it at any time, without giving a reason, by deleting your account (Account → Personal data → Delete; with a paid subscription, cancel it first, see section 9); your workflows, runs and connected-app grants are deleted with it. We may end it with 30 days' notice, or at once if you seriously or repeatedly break these terms or the law, telling you why.
11. Complaints
If something does not work as described, write to support@pathista.com with your account's email address, a description of the problem, and what you would like us to do. We answer within 14 days.
12. Changes to these terms
We may change these terms for important reasons — a change in the law, new features, or security. We announce changes in the app at least 14 days before they apply. If you do not accept them, you can delete your account before then.
13. Law and disputes
Polish law applies. If you are a consumer, you keep the protection of the mandatory law of the country where you live, and you may bring a dispute to the courts there. Consumers in Poland may also turn to a municipal or district consumer ombudsman (rzecznik konsumentów) or a provincial inspectorate of the Trade Inspection (Inspekcja Handlowa) for help settling a dispute out of court.
